If you’re inside the U.S. you can file for adjustment of status using Form I-485 (./form-i485).
If you’re outside the U.S: You must complete the process through consular processing at a U.S. embassy or consulate by filing Form DS-260 and attending an immigrant visa interview.
Determine that you are eligible to apply for adjustment of status, and that the immigrant visa category you’re applying under is available.
The I-130/I-140 petition may be filed before or concurrently with the I-485 application package.
Prepare Forms I-485, I-693, any other forms (I-765, I-131, etc) and all required evidentiary documents for all applicants and submit them to USCIS.
After you file, USCIS issues receipt notices confirming your case was accepted and providing receipt numbers you can use to track status.
USCIS will schedule biometrics (fingerprints/photo/signature). Attend the appointment as scheduled and bring required identification.
If USCIS needs more documentation, they may issue an RFE. Respond completely and by the deadline to avoid delays or denial.
Many AOS applicants attend an interview at a local USCIS field office. Bring originals, updated documents, and be prepared to confirm eligibility.
If approved, USCIS issues the Green Card. In some cases, USCIS may approve without an interview depending on the category and policy at the time.
The “90-day rule” is a State Department guidance concept sometimes discussed in the context of intent and changes after entry; it can be relevant depending on facts and category.
After filing, you may receive receipts, biometrics scheduling, possible work/travel documents, RFEs, and potentially an interview before a final decision.
Use your USCIS receipt number to track case status through USCIS tools and notices. Keep copies of everything submitted and received.
Costs typically include USCIS filing fees and medical exam costs (Form I-693), plus any other optional or related filings depending on your situation.
AOS applications require extensive documentation. Carefully review requirements, ensure forms and evidence are complete, and plan for timelines and potential follow-ups.
